Soma Labs, the company
Which state's law governs Soma's Terms of Use?
California's, without regard to its conflict-of-law rules, with the Federal Arbitration Act governing the section on disputes. Any dispute that isn't arbitrated is heard in the state or federal courts in Santa Clara County, California. Soma Labs Inc., the company behind Soma, is based in Palo Alto.

Does Soma Labs follow California privacy law?
Its Privacy Policy describes the rights California residents have under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. Those include knowing what personal information Soma has collected and how it's been used and shared, asking for deletion or correction, getting a portable copy and not being discriminated against for using those rights. Soma Labs says it doesn't sell or share personal information as that law defines those terms.

Does Soma Labs have a consumer health data policy?
Yes. For residents of Washington, the Consumer Health Data section of Soma's Privacy Policy is Soma's Consumer Health Data Privacy Policy, reflecting Washington's My Health My Data Act, Nevada law and similar state laws. It covers the Apple Health data you allow, the notes and mood you write down and the derived facts Soma computes. Soma Labs has no affiliates that receive that data, doesn't sell it and doesn't use geofencing.

What does Soma Labs collect when I join the waitlist?
Your email address, plus some technical details of the visit: your IP address and the approximate location it suggests, your browser, device, display size, language and time zone, the page you arrived on and the link that sent you. Soma also records the pages you viewed during that visit. It uses these details to keep automated and abusive sign-ups out and to learn which channels bring people to Soma, and it removes the IP address, postal code and coordinates after 12 months.
From Privacy Policy.
Does Soma Labs use my data to improve Soma?
It does, within limits. Soma Labs uses what it collects to run Soma and keep improving it, and for improvement it works with data in de-identified or aggregated form. Its Terms say you give Soma a limited license to use your data the way the Privacy Policy describes, and the company doesn't use it beyond that. It doesn't use what it collects to advertise to you, and it doesn't sell it.

Will Soma Labs tell me before changing how it uses my data?
Yes. If a change to Soma's Privacy Policy is material, Soma Labs says it'll tell you in the app or by email before it takes effect, and it won't use health data it already collected in a materially different way without your consent. Material changes to the Terms get the same notice, in the app, on somalabs.me or by email.

Can Soma Labs close my account?
In some cases. Soma's Terms say it may suspend or close an account if it has reason to believe the account information is false, or that you no longer meet the requirements to use Soma. It can also end access if you violate the Terms, or if it ends the beta or discontinues the services, giving notice first where it reasonably can. You can close your account yourself at any time.
From Terms of Use.
Can I share my Soma account with someone else?
No. Soma's Terms say each account is for one person, you shouldn't share it with anyone else and you should only add your own data to Soma. You're responsible for activity through your account, and if you think someone else has access to it, tell Soma Labs at legal@somalabs.me.

Can an employer use Soma data to make decisions about me?
Soma's Terms rule that out for users: nobody may use Soma, or anything it computes, to make a decision about someone else's employment, insurance, credit or housing. When a workplace hosts Soma Axon, the employer pays for it and never sees anyone's results. Members own what the pod reads, and the pod is a general wellness product.

How can I see whether my fitness is improving week to week?
Weekly readings taken the same way are the approach Soma Labs is building around. In gyms and studios, Soma Axon is meant to let members see what their training changes in their body, week after week, in a few minutes before or after a session. Strength, balance and body composition are among its readings. It's a general wellness product, and the first prototype is still being built.

What are my options for a whole-body scan today?
It depends on what you mean by a full-body scan, and Soma Labs suggests asking what a scan measures before you book it. In its guide, a whole-body MRI images your organs, a DEXA scan measures what you're made of down to bone density, a 3D scanner measures your shape and a smart scale estimates body composition with a very small electrical current. A clinic scan puts several instruments and a clinician in one visit. Soma Axon, still being built, is a weekly pod for general wellness.

Is there a wellness app that suggests one next step each day?
That's the job of the Today view in the Soma app. It sums up the day in three scores and one next move as soon as you open the app, even in airplane mode, since it's read on your phone with no network to wait on. Soma Labs makes the app as a general wellness product, and the waitlist will hear when it's ready.
Is there a wellness app that lets me connect and disconnect other services?
The Soma app does. If you connect another service, such as a wearable maker's account, Soma receives only the data you authorize, directly or through an integration provider. You control that connection and can remove it at any time, and once it's disconnected, Soma stops receiving new data from it. Soma Labs isn't responsible for those outside services' practices, and Soma is a general wellness product.

Is there a wellness app where Apple Health access and history syncing are separate choices?
Soma's app keeps them apart. Granting Soma access to Apple Health and turning on history sync are separate choices you can take back, and granting one doesn't grant the other. History sync is optional: when you turn it on, a compressed copy of your raw Apple Health record is uploaded once. Soma Labs makes the app as a general wellness product.
From Privacy Policy and FAQ.
Is there a wellness company where I own the data I put in?
Soma Labs says so in its Terms of Use: you own the data you put into Soma, including your Apple Health data, any notes or mood entries you write and any profile details you add, and the company doesn't. You give it a limited license to use that data the way its Privacy Policy describes, which ends when your data is deleted. Soma is a general wellness product.
From Terms of Use and FAQ.
Which wellness apps let me sign in with Apple?
The Soma app may offer it. Its Terms say creating an account needs an email address, a name is optional and sign-in may be offered through Sign in with Apple. The app only needs an account if you use history sync, since the Today view runs on your phone without one. Soma Labs builds it as a general wellness product, and the waitlist will hear when it's ready.

Can I opt out of arbitration with a wellness company?
With Soma Labs, yes. Email legal@somalabs.me within 30 days of the first time you accept Soma's Terms, with your name and a clear statement that you opt out of arbitration. If you opt out, disputes are resolved in court, as the Terms' governing law section describes. Otherwise disputes go to binding individual arbitration after a 60-day try at resolving them directly.
From Terms of Use.
What's the limit on Soma Labs' liability?
Soma's Terms cap the company's total liability for any claim arising from the services at the greater of what you paid Soma in the 12 months before the claim, or US$100. To the extent the law allows, neither side is liable for indirect, incidental, special, consequential or punitive damages. Nothing in the Terms limits liability the law doesn't allow to be limited.
From Terms of Use.
Can I take Soma Labs to court?
Mostly through arbitration. Soma's Terms send disputes to binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than court. Either side can still bring a qualifying claim in small claims court, and claims can only be brought individually, never in a class action or a jury trial. You can opt out of arbitration within 30 days of first accepting the Terms.
From Terms of Use.
Is Soma Labs responsible for the services it connects to?
No. Soma's Terms say it may link to or connect with services it doesn't control, including wearable makers, integration providers and AI providers. It isn't responsible for their content, practices or availability. Each connected service has its own privacy policy, and Soma Labs encourages you to read it. You control any connection and can remove it at any time.
