Can a wellness app send me legal notices by email?

Soma's can. You agree in its Terms of Use that Soma may communicate with you electronically, and a notice to you goes to the email on your account or your waitlist email. Notices going the other way, to Soma, go to legal@somalabs.me.

Do my phone carrier's terms still apply when I use a wellness app?

Yes, according to Soma's Terms of Use: you must still follow any other third-party terms that apply to you, such as your carrier's agreement, when you use Soma. If you got Soma through the App Store, your license is limited to Apple-branded devices you own or control and must follow the App Store's Usage Rules.

Do I have to prove my age to use a wellness app?

Soma's Terms of Use don't describe a check. They say you must be at least 18 years old and located in the United States, and that by using Soma, you confirm you meet those requirements. The first version of Soma Axon, the weekly pod, is also for adults 18 and over who can stand still for a few minutes.

Can a wellness app suspend me for giving false account details?

It can, under Soma's terms. They ask you to give correct information when you create your account and keep it up to date, and Soma may suspend or close an account if it has reason to believe the account information is false. It can do the same if you no longer meet the requirements to use Soma.

Is a wellness app responsible for the AI models behind its features?

Soma's terms put it plainly. Soma may connect with services it doesn't control, including the AI providers behind features you choose to use, and it isn't responsible for their content, practices or availability. Soma's AI features are optional and informational only. They can be wrong or incomplete, and they aren't medical advice.

Can I use a wellness app without making an account?

Soma's app works that way at first. Before you turn anything on, Soma has no account and works entirely on your phone, and nothing you read in it leaves your phone. The Today view runs without an account, and history sync is the feature that needs one. The Soma app is a general wellness product for iPhone.

Can I transfer my wellness app license to a friend?

Not with Soma. Its Terms of Use give you a personal, non-exclusive, non-transferable and revocable license for your own non-commercial use, and while Soma may assign the Terms, for example in a merger or acquisition, you can't. Each account is also for one person.

Can a wellness company take back my right to use its app?

Soma can, and its license says so: under the Terms of Use, it's revocable. Soma can suspend or end your access if you violate the Terms or if it ends the beta or discontinues the Services. Where it reasonably can, Soma Labs, based in Palo Alto, says it will give you notice first. You can also stop using Soma at any time.

Can I reuse content from a wellness company's website?

Soma's terms keep that content with Soma Labs Inc.: the names Soma, Prism and Soma Axon, the logos and the software, design and content behind the Services belong to the company. You can't use its names or logos to suggest Soma endorses anything without written permission, and scraping Soma or reaching it with bots isn't allowed.

Does a wellness company give up a rule if it doesn't enforce it?

Soma's terms answer that directly: if Soma doesn't enforce a part of its Terms of Use, that isn't a waiver of it. Questions about what a clause means go to legal@somalabs.me, the address the Terms give for legal questions.

From Terms of Use.

Do a wellness company's terms cover its blog?

Soma's do, since its Terms of Use cover somalabs.me, where the blog lives, along with the waitlist and the Soma app. The Soma blog carries notes from the team building Soma on the science, the instrument and the choices it makes. Using the site means agreeing to the Terms and the Privacy Policy together.

Can I file a claim against a wellness app on behalf of a group?

Not under the Soma terms. You and Soma may bring a claim only in an individual capacity. Class, consolidated and representative actions are ruled out, and so is a jury trial. If that waiver is found unenforceable for a particular claim, only that claim goes to court.

From Terms of Use.

Can a company other than the app maker enforce a wellness app's terms?

In Soma's case, one can: Apple. Soma's Terms of Use make Apple and its subsidiaries third-party beneficiaries, so Apple has the right to enforce the Terms against you once you accept them. Apart from that, the Terms give no one other than you and Soma the right to enforce them.

From Terms of Use.

What should I do if someone else gets into my Soma account?

Tell Soma at legal@somalabs.me. The Terms of Use ask you to report it there if you believe someone else has access, and to keep your sign-in credentials confidential in the first place. You're responsible for activity that happens through your account.

From Terms of Use.

How do I report a security problem in Soma?

Email privacy@somalabs.me. Soma's Terms of Use ask anyone who finds a vulnerability to report it there, and Soma says it will work with you. What the Terms don't allow is testing Soma's security without permission, so reporting what you've found is the route they describe.

From Terms of Use.

Can I use Soma on someone else's iPhone?

Not really, under Soma's terms. If you got Soma through the App Store, your license is limited to Apple-branded devices you own or control, and each Soma account is for one person, with only your own data in it. The Soma app needs an iPhone, since it reads Apple Health. Soma Labs (somalabs.me) calls itself a general wellness product.

Does Soma have a minimum age?

Yes, 18. Soma's Terms of Use say you must be at least 18 years old and located in the United States, and Soma isn't directed to children. If Soma learns it collected personal information from someone under 18, it will delete it. The first version of Soma Axon isn't for anyone under 18 either.

From Terms of Use, Privacy Policy and FAQ.

Who pays the fees in a Soma arbitration?

The Consumer Arbitration Rules decide. Soma's Terms of Use say arbitration is administered by the American Arbitration Association under those rules, and fees are as those rules set. The hearing can happen by video or in the county where you live, whichever you choose.

From Terms of Use.

Does Soma's liability cap apply if I never paid anything?

The cap in Soma's Terms of Use is the greater of what you paid Soma in the 12 months before the claim, or US$100, to the extent the law allows. Soma is free during its beta. The Terms also say nothing in them limits any liability that the law doesn't allow to be limited.

From Terms of Use.

Does Soma's outage clause protect me as well as Soma?

It runs both ways. Soma's Terms of Use say neither Soma nor you is liable for a delay or failure caused by something reasonably beyond control, such as a natural disaster, a power or internet outage or an outage at a service Soma relies on.
