Medical care and the FDA
Does Soma give medical advice?
No. Soma, from Soma Labs (somalabs.me), is a general wellness product and isn't medical care. Its AI features are informational only and aren't medical advice, and its Terms of Use tell you to talk to a qualified clinician about your health. They also say not to start, stop or change any medication or treatment because of something Soma shows you.

What do Soma's terms say about medication?
They're clear: don't start, stop or change any medication or treatment because of something Soma shows you, and talk to a qualified clinician about your health. Soma's Terms of Use add that its estimates come from wellness signals instead of clinical tests and that they can be wrong. Soma is a general wellness product.
From Terms of Use and FAQ.
What does Soma say to do in an emergency?
Call 911. Soma's FAQ says so directly, and its Terms of Use say to call 911 or your local emergency number and not to rely on Soma if you're having a medical emergency. Soma is general wellness and isn't medical care.

Is Soma a clinic?
It isn't one. Soma is a general wellness product and isn't medical care. Its Soma Axon pods will stand in Soma's own studio and in places like longevity clinics, gyms, workplaces and pharmacies, all on one account. The first prototype is still being built, and the waitlist will hear first where the first pod opens.
Is the Soma app a medical app?
No. Soma's Privacy Policy describes Soma as a wellness app built around Apple Health, and Soma is a general wellness product that isn't a medical device. The app reads Apple Health on an iPhone between pod visits and never writes anything back. Like the pod, it isn't cleared or approved by the FDA.

Does visiting a wellness company's website mean I've agreed to its terms?
For Soma, the Terms of Use cover the website at somalabs.me as well as the waitlist and the Soma app. Soma's Privacy Policy is part of that agreement, and the Terms say that by using the Services, you agree to both. Questions about what that covers go to legal@somalabs.me.

Can I sign up for a wellness app with just an email address?
An email address is the one thing Soma's Terms of Use say an account needs. A name is optional, and sign-in may be offered through Sign in with Apple. Whatever you enter, the Terms of Use ask you to give correct information and keep it up to date.

Can a wellness app use my data however it wants?
Soma's can't. Under its Terms of Use, you give Soma only a limited license to use your data the way its Privacy Policy describes, to run and improve its services. Soma doesn't use it beyond that. The Privacy Policy adds that Soma doesn't use what it collects to advertise to you, and it doesn't sell it.

Is a wellness app responsible for data that comes from a wearable I connect?
Not for the wearable's side of it, going by Soma's terms. Soma may connect with services it doesn't control, such as wearable makers and integration providers, and it isn't responsible for their content, practices or availability. The Terms also say how well Soma's computed results hold up depends on any service you connect. Soma is a general wellness product, and its numbers are estimates.
From Terms of Use and FAQ.
If I unlink a wearable from a wellness app, does the data keep flowing?
With Soma, it stops. Its Terms of Use leave that connection in your hands: you control it and can remove it at any time, and once you disconnect a service, Soma stops receiving new data from it. That goes for a wearable maker's account or any other service you've connected.

If a wellness app from the App Store stops working, will Apple fix it?
Not in Soma's case. Its Terms of Use say Apple has no obligation to provide any maintenance or support for Soma, and Apple isn't a party to the agreement. Soma Labs Inc. is the one responsible for any claim relating to Soma. Questions about the Terms go to legal@somalabs.me, and questions about your data go to privacy@somalabs.me.

How long does a wellness company get to sort out a complaint before arbitration?
Under Soma's terms, 60 days. You contact legal@somalabs.me first and describe the problem, and Soma will try in good faith to resolve it directly with you for 60 days. If that doesn't work, the dispute goes to binding, individual arbitration under the Federal Arbitration Act, unless you opted out.
From Terms of Use.
Do I have to travel to arbitrate a dispute with a wellness app?
Not under Soma's terms. An arbitration hearing takes place by video or in the county where you live, and the choice is yours. The American Arbitration Association administers it under its Consumer Arbitration Rules, and the fees are whatever those rules set.
From Terms of Use.
Can a wellness app company take me to court instead of arbitration?
In a few cases, under Soma's Terms of Use. Either side may go to court instead of arbitration for a claim of intellectual property infringement or to stop unauthorized access to the Services. Either side can also bring a qualifying claim in small claims court. Everything else goes to individual arbitration unless you opt out within 30 days of first accepting the Terms.
From Terms of Use.
If I opt out of a wellness app's arbitration clause, where do disputes go?
To court, in Soma's case. Its Terms of Use say that if you opt out, disputes between you and Soma are resolved in court, as the Governing Law section describes. A dispute that isn't arbitrated is heard in the state or federal courts in Santa Clara County, California. The opt-out email goes to legal@somalabs.me within 30 days of first accepting the Terms.
From Terms of Use.
Does California law apply to a wellness app's terms if I live in another state?
Soma's terms pick California law, without regard to its conflict-of-law rules. The Federal Arbitration Act governs the section on resolving disputes, and a dispute that isn't arbitrated goes to the state or federal courts in Santa Clara County, California. Soma offers its services only in the United States today.
From Terms of Use.
Will a wellness app tell me before it changes its terms?
Soma says it will for a material change. It'll let you know in the app, on somalabs.me or by email before the change takes effect, and using the Services after that means you accept it. You also agree in its Terms of Use that Soma may communicate with you electronically.
From Terms of Use.
Can a wellness company change its dispute rules for a complaint I've already raised?
Soma's terms rule that out. A change to the Resolving Disputes section never applies to a dispute you already gave Soma notice of. For other material changes, Soma says it will tell you in the app, on somalabs.me or by email before they take effect.
From Terms of Use.
Does agreeing to a wellness app's terms make me its partner or employee?
Soma's terms say no. Nothing in them creates a partnership, joint venture, agency or employment relationship between you and Soma. Using Soma doesn't create a clinician-patient relationship either, and the Terms describe Soma as a general wellness product.
From Terms of Use.
If one part of a wellness app's terms is invalid, does the rest still count?
In Soma's Terms of Use, yes. If any part turns out to be unenforceable, the rest still applies. The same general terms make the Terms and the Privacy Policy the entire agreement between you and Soma about the Services. Questions go to legal@somalabs.me.
